Terms & Conditions
These terms set out the basis on which Marea Scale Models accepts and delivers bespoke scale-model commissions. They are written to be clear and fair to both sides.
1These terms
These terms govern commissions placed with Marea Scale Models (“Marea”, “we”, “us”). By approving a quote or placing a commission you accept them. If we update them, the version that applies to your commission is the one in force when you place it.
2Commissioning and quotes
Every model is made to order. Following your enquiry and the free conceptualisation session, we issue a written quote, valid for 30 days. A commission begins when you approve the quote and pay the deposit. The quote, the agreed specification and the model maker’s brief together form our agreement.
3Prices and payment
Prices are in GBP and exclude packing, freight, taxes and import duties unless stated. The standard payment schedule is: a 50% deposit to secure your build slot; a further 30% at the 70% build stage; and the final 20% on completion, before dispatch. Packing and delivery are quoted separately at completion, because sea and air freight rates fluctuate.
4Approvals before manufacture
Before any material is cut, we provide a 3D visualisation and a model maker’s brief setting out sizes, scale, colours, materials and finishes. Manufacture starts only once you have approved these in writing. We build to the approved specification.
5Changes and variations
Changes you request after sign-off may affect the price and the lead time; we will confirm any difference in writing before proceeding. We may make minor adjustments necessary for sound construction without affecting the price.
6Lead times and delivery
Lead times are good-faith estimates running from cleared deposit and approved brief, not guarantees, and may be affected by matters outside our control. We arrange insured delivery; risk in the model passes to you on delivery. Please inspect the model on arrival and report any transit damage within 48 hours, with photographs.
7Cancellation and refunds
Because each model is bespoke and made to your specification, the deposit is non-refundable once work has begun, and the statutory right to cancel made-to-order goods does not apply (UK Consumer Contracts Regulations 2013, custom-goods exemption). If you cancel during the build, amounts become payable for work completed to that point. None of this affects your legal rights if a model is faulty or not as described.
8Your responsibilities
You confirm that the information, plans and photographs you provide are accurate, that you are entitled to share them, and that commissioning a model of the vessel does not infringe any third party’s rights.
9Intellectual property
You own the physical model once it is paid for in full. Marea retains all rights in its own designs, drawings, 3D files, methods and photography. Where a vessel or its branding is protected by a third party, any rights in that vessel remain with their owner.
10Confidentiality and privacy
We value our clients’ privacy. We will not publish your name or images of your commission without your consent, we will never sell or share your details, and we will not send you newsletters, frequent emails or spam. 11Handcrafted nature and care
Each model is handmade, so small natural variations are inherent and are not defects. Models are display pieces, not toys, and should be kept and cleaned as advised on handover.
12Warranty
We warrant that each model is made with reasonable skill and care and to the approved specification. Tell us promptly of any manufacturing fault and we will repair it or, at our discretion, remake or refund. This warranty does not cover damage from misuse, accident, handling or unsuitable display conditions.
13Our liability
Our total liability for any commission is limited to the price paid for it. We are not liable for indirect or consequential loss. Nothing in these terms limits any liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
14Events beyond our control
We are not liable for delay or failure caused by events beyond our reasonable control. Where they occur, we will keep you informed and agree a revised timescale with you.
15Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
